Legal Preparedness for Return to Syria

Preparation in terms of legal rights is crucial for Syrian refugees who are planning to return.

There can be few more difficult and complex decisions for refugees than if and when to return home after a long period in exile. When such a decision is taken, however, refugees should be supported to ensure that they are ‘legally prepared’ for return.

This means being aware of their rights, obligations and entitlements in both host country and country of origin and having the necessary support and documentation to be able to claim their rights and navigate the challenging road home. This is a fundamental component of any returns framework, as set out in the Comprehensive Protection and Solutions Strategy for Syria drawn up by the UN Refugee Agency (UNHCR), which highlights the need for physical, material and legal safety as an integral aspect of any durable return.
