Emergency compensatory measures: compensation for housing destroyed as a result of the armed conflict

NRC Ukraine presents a new report dedicated to problematic aspects of compensation for housing damaged or destroyed as a result of ongoing conflict in eastern Ukraine.

The purpose of the report is to analyse the Ukrainian legislation applicable to the armed conflict in terms of protection of the property rights of the affected population whose housing was damaged or destroyed as a result of hostilities. Much attention is given to current practice and experience of local authorities in different regions of Ukraine in the area of emergency response and recovery measures implementation, as well as social protection of emergency-affected population, including monetary compensation for housing lost as a result of emergencies of various natures (manmade, natural, social and military).

In addition, the report touches upon the issue of inefficiency of judicial remedies that are used for protecting the property rights of the conflict-affected population whose housing was damaged or destroyed as a result of hostilities within the legal framework of the anti-terrorist operation regime in the Donetsk and Luhansk oblasts.

The report with its findings and recommendations might be of interest to central and local executive bodies, local self-government authorities in charge of emergency response and recovery, social protection of conflict-affected population, as well as judicial branches of the Government.
